Focus Groups. Focus Groups typically consist of 8-10 participants that are recruited based on the demographics of the county in which the actual trial will take place. Generally, attorney(s) p resent both sides of the case either in summary format or by presenting opening arguments. Professional focus group moderators ask participants specific questions about case issues, themes and verdicts. A timely follow-up report and videotapes of the session are provided to the client. Attorneys may choose to hold a single focus group for a case or multiple sessions. Multiple sessions allow different sets of issues, approaches and theories to be comparatively tested. Each focus group lasts about 3-4 hours. Focus group results assist in litigation preparation by identifying strengths and weaknesses of cases, potential issues of concern to jurors and effective exhibit presentations. Mock Trials. These sessions are more comprehensive than focus groups. They are designed for attorneys seeking to test potential issues and themes of a case on a group of demographically accurate mock jurors. InFocus Research Group offers a variety of mock trial options as both half and full-day sessions: Single group: One group of 10-12 mock jurors serves as a single jury to which the attorneys present the case. The group deliberates and provides a verdict. Multiple groups: Two or more juries deliberate simultaneously and provide verdicts. This allows attorneys a basis of comparison. For more in-depth feedback, attorneys may choose different demographics for each jury in order to test their case on groups exhibiting different characteristics.
Regardless of the options chosen, sessions are completely customized. Attorneys choose the most appropriate information to be presented to the mock jury as well as the presentation format. Additionally, attorneys may choose to hold a single mock trial session or multiple consecutive mock trials. Consecutive sessions are most beneficial to attorneys still developing a strategy in that it allows testing of modifications based on feedback from previous groups. Post-Trial Interviews. Why did a jury arrive at its decision? Which themes work ed and which ones didn’t? How did jurors perceive the attorneys? the exhibits? specific pieces of evidence? Post-trial interviews are a cost-effective means of answering these questions.
